Study On Environmental Trade Measures Of The Agricultural Products

As the environmental deteriorated gradually, people have paid more and more attention to environmental problems. For each country and international social, environmental trade measures have become one of the important medias to coordinate the relationship between free trade and environmental protection. Agriculture industry highly depends on natural resources and ecology, adding its extreme importance for each country, so there lies rather specialty for the producing and trading of agricultural products. Whatever developed countries or developing ones should attach importance to protect their own agriculture industry and environment interests through environmental trade measures, therefore those measures were advanced rapidly, especially embodied in the international treaties. At present, understanding this issue in China mainly limits to those environmental trade measures, which prevents from exporting of China's agricultural products. The opinion not only stops China's environmental trade measures from perfection, but prohibits the trade of agricultural products and environmental protection from growth. Under this background, studying systematically environmental trade measures of agricultural products has great effect on theory and practice. Adopted some theory analysis and comparative research, the essay expands the recognition toward environmental trade measures of agricultural products in term of law, and makes some references to perfect China's legislation. The essay is divided into four parts.The first part starts from the concept of environmental trade measures and agricultural products, clearly defines environmental trade measures of producer, analyzes its character, and introduces the history and reasons of environmental trade measures of agricultural products. This part also prove the theory basis of environmental trade measures of agricultural products from sustainable development, economics and jurisprudence, and lays basis for understanding environmental trade measures of agricultural products properly.The second part compares the different measures taken by developed and developing countries during me implementing concrete environmental trade measures of agricultural products. According to this analysis, this part observes their similarity and diversity, and presents some basic regulations involved environmental trade measures of agricultural products in the WTO and Multilateral Environmental Agreements, which can help advance China's legislation and practice.
