Theory of Civil Society has many connotations and a strong vital force, which came from the west and was revived at the end of 20th century. Scholars had developed many comparative studies by reference to it. It is based on the specific western political, economic and cultural conditions as private international law. It is thought that the changes and developments of civil society have countless ties with the evolvement of theory of private international law. Recently significant development of theory of private international law was obtained, which needs to be completed. This paper studies the rise and development of private international law from the view of civil society to exploit new eyeshot with expectation, and provides reference to our practice of civil society and private international law.Because of its inherent economy tension, theory of civil society became global and a world trend without regional limitation. However, this theory is developed for a long history rather than being accomplished in an action. Therefore, the development of civil society theory is set forth here firstly, which is divided into classic theory of civil society, modern theory of civil society and contemporary theory of civil society.In classis theory of civil society, civil society refers to civilization whose opposite is wild society; it is not distinct from political society, the same as political society and civilization. Modern theory of civil society insists dichotomy that presents political nation and civil society, emphasizing that civil society is not political. Such a modern concept was presented by Hegel and completed by Marx. Hegel brought forward view of market economy of civil society, and distinguishes civil society and political nation definitely, thinking that nation is superior to and decides civil society. Marx received and developed his theory of civil society critically.
