Study Of Transformed Crime

The appellation of transformed crime was first created by Chinese scholars, it studies the transformation of different crimes in criminal law. In China, transformed crime is one theory that must be studied further. This theory has profound significance for legislation and judicial affairs of criminal law, and has unique value. This thesis has five parts:The first is Quo of Transformed Crime. Transformed crime in foreign legislation mainly exists in Continental Law System, because of the difference of legislation and policy, this theory has distinct positioin in criminal law. In Continental Law System, it is called"Paracrime"or"Pursue crime", and because their criminal law stipulates accusations more specific, there are few articles about it, and few scholars study it further; In China, it is called"Transformed crime", because there are many such articles in our criminal law, researching of this theory is more universal, but it has not formed a system.The second is Common Theories of Transformed Crime. To study it further, we must explicit the concept and the premises of transformation. The basic crime must establish, which is the foundation of transformation from minor crime to major crime. Transformation from illegal activities to crimes is only the process of crime, it is the issue of crime establishment, but not the issue of crime transformation. Furthermore, the premise of transformation must not be accomplished,some transformed crimes can transform frome preparatory and incompleted. Transformed crimes transform between crimes.
