21th century is a bio-science century, transplantation is the most excellent medical discovery in 21th century. This thesis intends to do good to our transplantation legality by the historical and comparative study on the history, purpose, social function and ethical problems, legal problems.The thesis consists of eight chapters, which are summarization, scientificalness, ethics foundation, jurisprudence foundation, social foundation, the involved problems, thoughts and basic principles and the body of law should be established.Chapter 1 and chapter 2 present us some elementary knowledge and fundamental theory to interpret the scientificalness of transplantation ,the curative effect is certain .Chapter 3,chapter 4 and chapter 5 discussed the ethics , jurisprudence and social foundations of transplantation, the transplantation legality is feasible. Chapter 6 discussed the brain death , repaid organ donation and organ exchange, the management organizations and their legal status.The followed two chapters discussed the legality thoughts, principles, the body of law and the current emphases. The author consider that the legality should be under the ethical principle's guidance, our main task is to cure the sickness and save the patient, then we can consider the development of science and technology. they are interpromoting. The basic principles are voluntary donor and voluntary recipient, to know the fact of the case then consent, no commerce, fairness, vocational qualification limitation, administration...
