In recent years, official offences characterized by groups, infusibility, correlation and other characteristics in our country. With the duty to explore the causes of crimes and to design the measures of controlling crimes, criminology ought to give these new characteristics an explanation and put forward some efficient controlling measures.On the basis of a review of the theory of white-collar crimes in western criminology and the theory of official offence in our country, this thesis summarized the basic viewpoints and methods of these theories and formed a basic model of the theory of official offence subculture. Moreover, it designed a series of theoretic supposes on the basis of the model. Aiming at these supposes and using the analytical method on literature, it demonstrated these supposes using the practicalities of official offences and came to a conclusion: Power and money are some national public servants'goals. The legal means to achieve these goals are limited. When the national public servants who are pursuing these goals lack institutionalized means which will help them to achieve their goals, they will have the feeling of frustration. If they have the opportunities of gaining non-institutionalized means which will help them to achieve their goals, they will probably use these means (namely commit official offences) to achieve their goals. If they lack not only institutionalized means but also non-institutionalized means, or they only lack institutionalized means but have non-institutionalized means and there are hindrances such as overawing power from penalty, they will adjust their goals and begin to pursue their new goals. When many national public servants commit official offences, there will form a kind of official offence subculture group and official offence subculture. As the special functions and regulations of official offence subculture will give the group members encouragement and sustenance, this will boost up the subculture group's attraction for the national public servants. On the other hand, the special regulations of the group will exclude and punish those members who do not conform to the regulations. The actions of pushing and drawing from the group drive the group members to conform to the group's special regulations, and the result of conforming are to commit official offence. The theoretic supposes above not only can be demonstrated by data, but can explain the new characteristics above that nowadays official offences have emerged. Therefore, The author put forward corresponding measures and suggestions of preventing and controlling official offence on the basis of the analyses. |
