Research On The Legal System Arrangement And The Law Enforcement Costs

Nowadays there are many problems in our legal system construction . Such as law of supply and demand imbalances, implementation results departing from legislation expecting and lack of the social rescore supporting. To rationally allocate the scarce legal resources, this article analyses the implementation cost and its influence to the legislation, and table some proposals about perfecting our legal system.Firstly, the article analyses the implementation state of law and point that this is a legislation of perfect state. Then how to make rule in the perfect state is discussed. Secondly, the article point that perfect state haven't existent in the life and construct cost is can saw everywhere. In the legal system, there are legislation cost and implementation cost. And the latter can divided into the executive cost, the justice cost and the law-abiding cost. And the relation between legislation cost and implementation cost is discussed. The following part is the keystone of the article. This writer from the timing, content arrangements, language and logical rigorous legislative technical aspects specific analysis of how the legal system impact the implementation cost. And the last, some measures about the legislation under the restricting of the implementation cost are put forward. That are establishing the correct legislation values, hold the legislation timing, establishing complete property rights system, establishing the legislation forecast system and perfect the legislation process.
