Present Station And Innovation Of Contemporary Chinese Administration Hearing Mechanism

The administration hearing mechanism is a procedural legal mechanism, which is meaning the administrate authority should hear the voice of interested person on the fact and law of the case in discussing before they use their power to make the un-interest decision to appositive party. The hearing mechanism has a long history in the foreign countries, but it appeared in our country till 1990's, and it is still at the beginning stage, and there are many theory and practice problem need to study and improve.At the first part of this paper, author introduces some general concept about the administration hearing mechanism, such as its definition, character and principle, as well as, its development history in China.At the second part, the author analyzes our country's administration hearing mechanism how to run and its relative rules and law. To analyze the hearing mechanism's running station, the author takes our railway freight hearing as sample, and discuss the relative factors, such as the relative law, how to choose the representative, the representatives how to express their advice and the hearing's effect by graph in detail. And at the end of this part, the author gives out a general comment on hearing mechanism.At the third part, the author gives out some ideas on how to innovate our country's hearing mechanism. The author thinks our country should put much attention and strength on administration hearing mechanism's extent, applying scope, arranging, and how to take down in writing. And the author strongly hope our country should the administration hearing mechanism can be applied on more important aspects which have key interest to our life.
