Research On Some Questions Of Bribery Crime

Taking consummating our country' s legislation regulation as the aim, using other country' s law regulation experience on this kind crime for reference, this article studies some disputed basic problems of bribery crime. For the reason of length, this paper doesn' t pays attention to all questions of bribery crime but some outstanding ones.First part mainly discusses some questions on the body of bribery crime. In this part, on the base of analyzing other scholars' viewpoints, the author gives his own point of view on the bound of state company , enterprise, demos group, accredited personnel.The second part expatiates on if "gaining interests for others" can be an important document of bribery crime. The author suggests canceling "gaining interests for others" this objective factor, on this base, giving different penalty on "gaining proper profit for others" and "gaining improper profit for others" .The third part discusses the essence of bribery crime subject.
