The Study On Death Penalty Restriction In Our Country

In recent years, the problem of death penalty has become a hot topic in our academic circles. Of course, this is connected not only with the target of constructing socialist political civilization and harmony society in China, but also with the world trend and international tendency about abolishing or restricting death penalty, especially with the degree of our country taking part in international society. At the crossroad of retaining or abolishing death penalty, it is a difficult problem how to confront death penalty.From the evaluation of death penalty 's reserving or abolishing, this paper analyzes the basis of death penalty restriction in our country. At the same time, we put forward the specific conception on death penalty restriction. The thesis includes three parts.The first part: by evaluating the dispute about death penalty's reserving or abolishing, we find the scientific way how to treat death penalty. That is to say, we should connect the trend of death penalty's historic development and one nation's condition of the country. So death penalty cannot be abolished at once or retained entirely in our country. But it is right that restricting death penalty strictly. It is standpoint and starting point of this thesis.The second part: by narrating the historical development of death penalty and the current circumstances of material civilization and moral civilization, we conclude the historical basis and realistic basis of our country's death penalty restriction. So restricting death penalty is a realistic and reasonable choice in our country.The third part: we put forward the specific conception on death penalty restriction. Based on the research achievements of abolishing or restricting death penalty in our nation and the practical experience in others, the author thinks restricting death penalty is a social problem, concerned with various fields, depending on every social stratum's joint efforts, of the common people, jurists and statesmen. At the same time, we should make efforts in economic field and legislative, judicious field. All these are effective measure and inevitable route in death penalty restriction.
