| The relationship between mankind and the emironment is a both old and new subject. After fighting against nature for hundreds of years, human beings have developed themselves, remoulded the nature and imprinted with their activities all the areas where they have been. However, as a result, today's emivonment is no longer the one of the ancient times. Human beings have changed it and it has paid them back. Ecological deterioration, depletion of natural resources and emiromental pollution have become the new issues people encounter in the process of development. Now man has realized the importance of emironmental protection by introspecting his mistakes. As the public are more aware of the emironment, more and more citizens turn to law to protect their legal rights and benefits. Therefore, the environmental public service lawsuit system has attracted people's attention and become the focus of judicial practice and the social life. Now the countries all over the world are working actively to push forword the development of the system. China has also made some accomplishments in this aspect but the imperfect legal system is detrimental to the protection of emironment and public benefits. This paper starts with the theories of the system and introduces its concepts, features and effects. On the basis of the disadvantages and obstacles of the system, combined with the reality of China, the importance of public participation is pointed out and the problems are proposed. At last,based on the references to other developed countries' knowledge of the system, the author takes the present situation and the practice of the system in China into consideration, focuses on the analysis of the shortcomings of it and the problems of public participation and suggest setting up and perfect the public participation system in the nvironmental public service lawsuit system, in order to improve the emironmental protection and to realize the sustainable development of the society . |
