Study On Judicial Power Of Interpretation

This paper regards judicial power of interpretation as the research object,and regards power as the visual angle ,and makes use of the method to analyse and the method to compare, and has explained the power position of the judicial power of interpretation and power value, and reveals the current judicial operation mechanism existing problem of power of interpretation in our country and improved method based on this. And I hope that I can do a helpful try to perfect the judicial operation mechanism of power of interpretation of our country.This paper divides four chapters altogether. Chapter one Ontology of the judicial power of interpretation. This chapter is described from four respects, such as concept, subject , target , characteristic ,etc. around the judicial power of interpretation, to make people have a basic understanding to the judicial power of interpretation. Chapter two Function of the judicial power of interpretation, through an analysis of function of the judicial power of interpretation, make people strengthen the understanding of the importance to the judicial power of interpretation. Chapter three Comparation of judicial power of interpretation, take classification of the legal power of interpretation in our country as the backgroud, pass the comparative analysis to the judicial power of interpretation and the legislative power of interpretation , the administrative power of interpretation, point out what of our country the legal power of interpretation classify unreasonable , and judicial development of power of interpretation in our country form and hinder, make it deviate from real judicial power of interpretation. This kind of analysis helps us to understand the judicial power of interpretation more deeply. Chapter four Practice of the judicial power of interpretation, regards actual operation situation of the justice power of interpretation in our country as the analytic target,through four respects, such as subject, content, form , procedure ,etc. , reveal the current judicial operation mechanism existing problem of power of interpretation in our country, and has put forward some perfect suggestions from these four respects , and is in the hope of being of value to theadministration of justice afoot of our country to reform the activity. This is summing up some and purpose of this paper too.
