The Analysis On Protecting Bussiness Secret In Law In The Category Of Anti-Unfair Competition

Business secret is special intellectual property and information. It can't be known by the public as usual, but can bring huge economic benefit and applied value to the obliges. It's also protected by some rational measures for keeping secret. Along with the development of economy, c has played an important part in competition and society, and some correlative issues in law have been obvious either. Now, these issues have aroused many legists' attention.The paper discusses some issues in the category of anti-unfair competition. It expounds the essential theory on business secret and its legal protection firstly. And secondly, it discusses the value and feasibility of regulating business secret with the law against unfair competition. Lastly, it brings some simple suggestions to consummate our legislation on business secret. In author's opinion, "anti-unfair competition" is an extensive conception. The law against unfair competition also includes two meanings of narrow sense and broad sense. The narrow sense is the law named "Law Against Unfair Competition", and the broad sense is the summation of all the laws about competitive actions. So, the legal protection on legal protection in China doesn't only include some legal norms in the law named "Law Against Unfair Competition", but also include other contents. Even we will establish the separate law on business secret in future, it also belongs to the category of anti-unfair competition.
