Research On The Social Security System About Patients' Right In The Relations Between Patients And Hospitals

The disputes between patients and hospitals have risen and become one of the main aspects of social disputes in recent years. The main factor that led to this is that there are certain serious problems on the social security rights of patients, such as low social security coverage, the lack of social security funds, impact of the market economy on both sides, and at the same time, as for the legal system, there are some inadequacies in the legislation, judicature, administration and other aspects and it needs immediate improvement.The author begins his talk by analyzing the characteristics of the relations between patients and hospitals firstly, and then he gradually begins to analyze the causes of the disputes between patients and hospitals, system deficiencies and the positioning of patients from the point of view of law, and ultimately patients are considered as the vulnerable group. Vulnerable group is a social problem, and the protection of vulnerable group is a complex issue. Learning from the foreign experience on the social security rights about the patients, we are aware that our legislation to protect the rights of patients should pay attention to the followings :1. Speed up the progress of making the social security system a law.2. Set up the basic social security system appropriate to national conditions.3. Perfect the social insurance.Bases on this, the author forms some plans on protection system of patients rights. The main idea is to protect the rights of patients through specialized, scientific legislation, including suggestions such as the establishment of the Fund, the compulsory insurance, the establishment of autonomous initiatives and mandatory complex combination of medical arbitration mechanisms, the establishment of the Tribunal for medical and so on.
