On The Utilization Of Systems Of Water Rights On The Yangtze River Diversion Project

Because of the uneven distribution of water resources in our country, the water quantity in some areas is abundance but in some areas is scarcity. Especially in different drainage areas, the disparity is more obvious, which makes the trans-regional water drainage becoming a solution to solve this problem. Nowadays, the Yangtze River Diversion Project is the biggest trans-regional water drainage project in our country. The water rights in this project is an important factor which connects to the running and managing of water drainage. Based on concluding the legal experiences of foreign countries and theories of water rights in our country, this paper try to build the system of water rights in the Yangtze River Diversion Project.The paper has four parts. The first part is the introduction, which points out the meaning of this paper, the situation and way of research. The next part discusses the practice of the water rights system and the transaction of water rights in our country, which is the base of theory and practice in this paper. The third part introduces the situation of the Yangtze River Diversion Project and the legal problems of water rights in our country, and this part points out the importance of the water rights' running in the Yangtze River Diversion Project and sums up the legal experiences of trans-regional water drainage in other countries. The lastpart is an important one, which put forward how to build the system of water rights in the Yangtze River Diversion Project, including how to define the water rights in the Yangtze River Diversion Project, and how to perfect the water rights allocation, the water rights transaction, the water rights management and the water rights system.
