A Study On Collective Bargaining Right

Our country is making great efforts to build socialist market economy, in this course, the employer's status and power are enlarged excessively, but the laborers' rights and interests are unable to get the effective guarantee. So we should study advanced experience of other market economy countries and strengthen the work of legislation to protect the laborers' legitimate rights and interests, to alleviate out-of-balance in power between labor and capital, and maintain the stability and harmony of the work relation. Three rights of work are undoubtedly the focuses of legislation to ensure. This thesis exhaustively argues collective bargaining right among them .The chapter one analyzes the intension of collective bargaining right and essential features in detail, proves the subject and content of collective bargaining right, makes clear historical development of collective bargaining right and expound realistic meaning of collective bargaining right; The implementation of collective bargaining right requires other relevant measures to ensure , so, three latter chapters argues enforcement of strike right, effect of collective contract, and prohibition of improper work, to make every effort to draw a complete description of collective bargaining right. While explaining the advanced theory in the world, the thesis concentrates on pointing out the deficiency and limitation in protection of collective bargaining right in our country in the last chapter. On this basis, the author proposes direction of improvement in the future and explains relevant measures to perfect one by one.
