| The prevention of the power abuse is the most important and most difficult point for corruption issue. The basic human desire for material and sex is the source of the power abuse. "Sex corruption"is a kind of corruption that causes damages to business and is harmful to people. And it is all-pervasive in the real world. "sex corruption"takes the most basic sexual desire existing in human deep nature as the motivation. Law is the best method to prevent corruption and limit the power abuse. So it is important to analyze and solve the sex corruption from legal rules. From the view of legal rules, we should consider sex corruption from three aspects: validity basis, logic of law and social effect of law, because, instead of meditation, we'd better to explore and reconstruct from human experience in history. In this way, we can find the solution more easily. According to the internal logic of legal sense, legal limit and administration towards power abuse, this essay will probe the validity and rationality of the control of the sex corruption in ancient China from legislation background, punishment system, legal responsibility, and practical use. From this, we can have a correct understanding of sex corruption in legal theory and in legal practice, and show the necessity and feasibility of making legal rules towards sex corruption. |
