Comparative Study On Legal System Of Housing Mortgage Loan In The United States And China

Entering 21st century, along with the accelerating process of reform in housing system in our country, as well as the fast-rising marketing degree of house supply and demand, stronger requirements to improve the process of perfecting the legal system of housing mortgage loan have been made by every part in the society. However, the legal system of housing mortgage loan in our country is at the starting stage now, and it is a long way to reach the maturity stage. Therefore, we need to study the foreign legal systems of housing mortgage loan so as to find out the system frame as well as laws and regulations, which are suitable to system environment in our country.This thesis will compare and dwell on the legal system of housing mortgage loan in China and the United States, then put forward sound tentative suggestion to develop and improve the legal system of housing mortgage loan in our country. There are totally seven parts in the thesis:Part A is an introduction to the definitions, legal characters, legal relationship involving, relationship and difference with relative concepts.Part B is a brief introduction to the development process of the legal system of housing mortgage loan in China and the United States.Part C is a detailed introduction to the legal systems of primary and secondary market of housing mortgage loan in the United States.Part D is a detailed introduction to the legal system of housing mortgage loan in China.Part E and F are the key components of this thesis. Part E is the comparative study on the legal system of housing mortgage loan between Chinaand U. S. A. In part F, suggestions to perfect the legal system in our country are made through taking advantage of the legal system of housing mortgage loan in the United States based on the results of above mentioned comparative study.Part G is the conclusion of this thesis.
