Research For A Number Of Chinese Recidivism System

recidivist system is ancient criminal law ,it has a very important position in criminal law .Great change has take place in China,But in our country, systematical study and deep analysis about the recidivist system is insufficient , which is not worthy of its status in the criminology system. This article states and analyses comprehensively some important contents of ou recidivist system.The author uses the experience,both ancient and modern,Chinese and foregn,for reference and makes an all-round discussion of Chinese recidivist system.The dissertation is organized in five chapters, 40,000 words in all. Chapter one is a preliminary description of recidivist system.In this chapter ,the development of the concepts and the theory of recidivism and recidivist institution,at home and abroad, is presented.The author follow the hostory of retributive theory of penalty and the utilitarian theory of penalty , and show the good and bad of two theories. Chapter two canvasses the important factors of general recidivist system in constitutional conditions and legal liability.The author analyses the theoretical basis for recidivist system in constitutional conditions according the theory of recidivism discussed before ,and give the own point of views on how to perfect the constitutional conditions of recidivism, in our criminal law. In chapter three ,the author discuss the important factors of special recidivist system in constitutional conditions and legal liability and give the own point of views. In chapter four , this part makes detailed comparison and analysis about punishment principle of recidivism between Chinese and Foreign criminal law and puts forward its own stand points on how to perfect the punishmentprinciple of recidivism in our criminal law. Chapter five discuss the corporate recidivism.
