Chinese Travel Legislation And Protection Of Tourist's Rights Under GATS Frame

Tourist industry has already become the fastest developing speed industry in the world, playing a more and more important role in the international economy. Entering 1990s, the development speed of tourist industry had already occupied the first place, becoming the greatest industry in the world. After China joins WTO, CATS rule and principle will apply to our country, the opening to the outside world of tourist market will be expanded progressively, will totally open to the world by 2005. It is worth considering how to make the legislation of service trade of our country,especially travel legislation to be concert with the rule of GATS and principle system. Though on the surface, what GATS involved is mostly the rule of the service trade field, but its aim is to dispel government's barriers to service trade of various countries, utilize resources most rationally, set up a intact one, have vigor and permanent multilateral service trading system even more.No legal system practice,nor orderly market environment, we can not enter the universally acknowledged ranks of developed country of travel. This text comparises with the other developed country's travel legislation and argumentation to the respect of protection of consumers'rights, China after emphasizing " entry to WTO " must abide by GATS about general obligations , such as transparency and most-favored-nation treatment ,etc. , requiring the legal system of our country to be in line with international standards . So it is very important to probe into our country's travel legislation , especially probe into the issue obstacle of Basic Law of the travel and attempt to put emphasis on protecting travel consumers' legitimaterights, in order to seek the effective way which clears away the deficiency and drawback existing in travel legislation of our country, in this way , we can keep the lasting prosperity of the tourist industry of our country .
