On Protection From Criminal Law On Male Sexual Right

Nowadays, more and more cases have been reported regarding violation of male sexual right. From these reported cases, male could be sexually assaulted by either male or female, and husband could even be raped by his wife. These cases increase author's concern over the protection on male sexual right.Upon his definition over the terms as sexual right, sexual assault and sexual crime, author addresses that male and female shall enjoy equal sexual right in respect of legal terms. But the Chinese Criminal Law is unfortunately silent in protection of male sexual right. Author is to clarify the reasons of such embarrassing situation.Author also urges to strengthen protection from criminal law on male sexual right upon a rapidly changing situation which objectively requires a proper response from the legislations.Finally, author introduces and analyses global trend over protection from criminal law on male sexual right, and upon which present his amendment proposal over the current Chinese Criminal Law provisions. The proposal briefly reads that: First, rename the crimes into rape and filth; Second, extend the range of possible victims; Third, establish sub-crimes under rape and filth upon the assault happened under different circumstances; Fourth, peremptory sexual act between husband and wife shall be considered a crime provided the victim claimed as such.
