A Research On The Development Of International Direct Investment Law And The Improvement Of The Foreign-Investment Law Of China

International direct investment is developing increasingly since the World War II, and becomes the major means of international capital flowing. The investment also covers different fields. Especially since 1990s, the need of developing economy and technology and adjusting industry structure in developed countries and the need of relieving foreign debt, developing or transforming economy in developing countries urge all countries to adjust and improve the legislation of foreign capital, resulting in the fierce competition in attracting international direct investment. Under this situation, international organizations, such as regional organizations, UNCTAD, WTO, IMF, OECD etc., successively make active efforts to establish a complete set of investment rules. This international and national practice reflects rightly the development of international direct investment. This thesis will set out from the angle of the host country and discuss the tendency of legal system of international direct investment reflected in civil laws, bilateral investment treaty and multilateral investment treaty, and multilateral investment treaty and will also discuss the improvement of law in china.This thesis includes four parts:Part I: summarize international direct investment, including the conception, characteristic, forms and its recent development.Part II: Discuss deeply about the international direct investment legislation: firstly, discuss about the domestic law of the international direct investment; secondly, discuss about the international law of the international direct investment.
