Terrorism And Criminal Legislation Of China And International Conventions

The purposes of this theme are described in the two followings :firstly,give my own logic decision concerning the concept 0f terrorism and search for the deep roots of terrorism;secondly,through analyzing the criminal legislation relating to terrorism in international conventions and Chinese Criminal Law the advantages and the shortages of criminal legislation are shown and my own advice on improving its shortages is also provided. Based on the above purposes I arrange this theme by the way of the integration-of analyzing terrorism as the special social existence and relating criminal legislation in theory and practice .(A)Analyzing terrorism as the special social existence.Firstly,based on different kinds of concepts of terrorism and its legal characters,I give my own decision on the concept of terrorism in the following:'Terrorism Can be understood such illegal or criminal behavior that nations,groups or individuals with different ideologies plan to terrify the whole society and realize their different purposes by making use of violence or other destructive ways on general objects(including military and non-military targets) . Secondly,by analyzing the histOric and CUrrent roots of terrorism I explain the reasonableness of the existence of terrorism with human beings and indicate the direct influence of current society on terrorism . Thirdly,by reviewing the history and analyzing current situation of two main important types of terrorism in the contemporary era , namely,extreme nationalism terrorism and extreme religion terrorism,indicate the deep roots behind terrorism and based on the nature of terrorism and the general trend of the world forecast the future development of terrorism . (B)The criminal legislation relating to terrorism . Firstly,analyze international conventions concerning terrorism from global and regional angles and give advice on improving their disadvantages.Secondly, analyze the criminal legislation relating to terrorism in Chinese Criminal Law and the advice on improving it from substantial law,procedural law and comprehensive law enforcement system is provided. In short,this theme analyzes terrorism not only from the angle of social theory but also the criminal legislation concerning terrorism in international conventions and Chinese Criminal Law.The historic review and analysis of current situation of terrorism help me to learn about the nature of terrorism and get clear image of the future terrorism:Terrorism is the complex social existence , including political , religionary,economical,historical,cultural elements,etc,and it will accompany with human beings in long term and reflect different characters in different ages.On the other side.the analysis of the criminal legislation relating to terrorism in intemational cOnventiOns and Chinese Criminal Law indicates the advantages of criminal legislation on controlling and punishing terrorism and my own advice to improve the effect of criminal legislation in practice is provided finally.
