Probing Into Psychological Foundation Of Rule By Law In Contemporary China

Since putting forward the proposition of running a country according to the lawand locking of the goal becoming the country governed by law, rule by law hasalready become a kind of popular words. But at the same time, it is quite serious thatruling by law is a superficies at the same time, in the minds of people, it is still only akind of ideal to rule by law. It can't be rooted in the hearts of people; this hinders thefoundation of society governed by law seriously in our country. Reason includes thatwe lay particular stress on the constitution of legal system and inoculation with thetheory of western law, and has neglected the soil analysis of rule by law; lack therational thinking to it, thus it is unable to find the psychological foundation to rule bylaw in our country. This paper regards constructing the society ruled by law as thebackground, with the new angle of view probing into constitution of the society ruledby law, namely law psychology, considers that it is an essential link in law systemengineering to cultivate psychology foundation of law.The major work of this paper is as follows:1.Some question existing in the process of rule by law is analyzed; profound reason isexcavated, namely psychological foundation.2.The necessity of psychology of rule by law is stated through understanding themeaning of rule by law with psychology, and their relation.3.The concept and behavior of the psychology governed by law are discussed simply;the reason that psychology of rule by law lacks is analyzed from microcosmic facts,theory foreshadowing, tradition or habit, faith.4.The approach of fostering psychological foundation is discussed;That initiation ofrule by law is the key to push rule by law effectively, and the way to initiation canonly be a combination of Chinese and Western mode.5. The reason why westward psychology of rule by law comes into being is analyzed,by contrast with this, seeking psychology rule by law which can adapt to build rule bylaw in our country. From humane spirit,democratic system,legislation,moral andso on, This paper probes into the connection with rule by law, then through be acombination of Chinese and Western mode ,excavates and fosters the psychologicalfoundation of rule by law in China.Approach using in this paper is as follows: (1) theory analysis combines withhistory analysis; (2) induction combines with comparison; (3) standardization analysiscombines with demonstration analysis. Various kinds of the methods mentioned aboveare used alternately to carry on the perspectives and analysis to different problems.
