On System Of Court-conciliation

There are four parts in the essay:The first part is on the meaning of court-conciliation. First of all, the author introduces definition of conciliation and court-conciliation; Secondly, main values of court-conciliation are liberty, efficiency and justice, which should be kept in a state of balance through proper ways. Finally, the author introduces the history of court-conciliation in China. To the author's mind, court-conciliation contains all kinds of conciliation activities held, conducted and controlled by courts. This part in the essay will provide the history surroundings for analyzing and advancing the condition of court-conciliation in China.The second part is on similar system in some other countries and districts, which might be absorbed by court-conciliation in some means.The third part is on the condition of the system of court-conciliation in China, which includes three parts: Reformation of court-conciliation in China; Reform experiment on court-conciliation of parts of local courts in China; New regulations of court-conciliation in the newest judicial interpretation of the highest court. At the same time, to the author's mind, it firstly ought to be solved that court-conciliation and judicial procedure both exist in the same judicial procedure. It will is rather necessary to progress court-conciliation in China.The fourth part is on reforms of court-conciliation in China. In the part, I put forward my suggestions: Court-conciliation contains preceding court-conciliation and in-litigation court-conciliation. In my opinion, court-conciliation and judicial procedure ought to be separated.
