Researches On Online Arbitration

With the rapid development of electronic commerce, more and more online disputes appear. Because the characteristic of online dispute, network becomes the best choice. Online arbitration emerged in this context. The definition of online arbitration is using the electronic technology and the Internet, makes the whole process or the main stages of arbitration carrying on the web though e-mail, online chat rooms and audio-visual facilities supporting the Internet. Both at home and abroad all have online arbitration practices. There are some successful online arbitration such as domain name dispute, but, the relevant theory research is extremely poor. As something new, lacking enough time to accept and imperfect network technology, no legislative support, all of this makes it even more difficult. Online arbitration will become the trend of Arbitration with its unique cost savings, improve efficiency and convenience features.There are four parts in the article.The first part is the online arbitration summary. These two chapters are all try to find the solutions for the problems in the process of establishing online arbitration system. Specifically, chapter two is about how to make sure justice and confidentiality for the parties. The third chapter is to explore the issue of online arbitration platform. Construction of the platform should refer to existing arbitration law, Consider specific circumstances of parties and problems that may arise, give the parties maximum protection and convenience under the existing technology. The fourth chapter discusses ways of spreading online arbitration, the reform on online arbitration, two legislation models, adding online arbitration chapter in now arbitration law or adding this law is applicable to online arbitration.
