The Study On Administrative Prompt Coercion: To Urban Integrated Enforcement Management As An Example

Urban integrated management institution (the relative concentration of administrative punishment institution) plays a significant role, but also has many problems. The problems often occur when the administrative subject do the behaviors of prompt coercion. Therefore, in order to saving the problems of urban integrated management, we have to do same research on the prompt coercion. In this paper, I analyzed the feature and the content of prompt coercion and defined the meaning of the prompt coercion. The prompt coercion means, in response to emergency situations or preventing illegal conduct or achieving a particular administrative order, without such procedures as decision, Chief relative take direct measures. The prompt coercion is immediate and coercive. Based on the analysis of the basic theory, the legislation and the execution of prompt coercion, we come to the subject, form, principle, conditions, and procedure of prompt coercion. And then, I gave some suggestions to the urban integrated management. The suggestions are making the setting subjects clear, completing the legislation of the enforcement of the prompt coercion, completing the legislation of the conditions of the prompt coercion, completing the legislation of the procedures of the prompt coercion and definitude the legal status of administrator.
