Research Of The Criminal Trial Cross-examination System

In countries of Anglo-American law system, cross-examination is a kind of criminal trial system that can not be ignored. From the present situation of our country's criminal procedure to see, we don't have completely absorbed and use cross- examination this system, that in front courtyard careful cross-examination judicial practice has many problems. Therefore, in our country at present trial mode reform process, research cross-examination system is necessary. In this paper, the concepts of cross-examination based on analysis of the cross-examination situation, by analyzing the shortcomings of existing building to achieve a reasonable and sound system for the purpose of cross-examination. This article is divided into preamble, body and conclusions of the three parts of the body which includes the following four parts:First part is an overview of cross-examination. We mainly introduce cross-examination from the concepts, procedures and values of cross-examination. Focus on the analysis of cross-examination of the substantive and procedural values, as a whole thesis argument.The second part is to investigate and comment on common law cross-examination. Focus is to introduce the common law rules in cross-examination and the related system of protection.The third part is to describe the status of cross-examination. In summing up China's current Criminal Procedure Law on cross-examination of the legislative and the characteristics, try to derive from analysis of cross-examination of the current system deficiencies.The fourth part is the improvement of cross-examination idea. Mainly from the improved procedures, improve cross-examination the rules and improve the three aspects of the protection system established on cross-examination in the criminal court system in China.
