With the intellectual property rights capitalizing, intellectual property rights strategy globalizing, intellectual property is no longer a simple legal rights, but more ascountries and the enterprise a kind of competitive tool and business strategy.Intellectual property dissimilation phenomena and the conflict of intellectual property rights increasingly wide and intense, which initiated us to think over its justification ,relief and the theoretical value . In the second part trace, introducting the origin of intellectual property rights and the philosophy of law foundation to find the purpose of legislation perspectives intellectual property value goal, reveal the legitimacy of the alienation of intellectual property rights conflict coordination essence and principle.
