The essence of employment discrimination is an aggression of equal rights of citizens,damages the public interest and causes credit crisis. It also brings huge hazard to the unemployed workers and vulnerable groups of special and it is the largest potential danger of intensifying social order and stability. This situation has caused great attention of all kinds of fields, especially in the areas of law, and some legal provisions on prohibiting employment discrimination have been lain down. Anti-employment discrimination has made great effectiveness. But the judicial system is not perfect to resolve the problem of employment discrimination. On the one hand, Because of the incomplete of the case range,the restriction on qualification of the plaintiff and hard evidence and expense of litigation cost and so on, the victims are blocked outside the gate by the Civil litigation law. On the other hand, for the same reasons, the victims can not get judicial relief from the Administrative Litigation Law. As for the Criminal Procedure Law, it has no rules for prohibiting employment discrimination. So we know Chinese traditional litigation system can not effectively carry out relief to victims of discrimination. The public interest litigation can make up for the fault which the traditional litigation system restrict the qualification of the plaintiff. The purpose of public interest litigation is to protect the national, social and public interests and pursue social justice and fairness. And the essence of the anti-employment discrimination is to safeguard the public interests. It reflects that they are fit. Therefore, we may protect the legitimate interests of the victims of discrimination through building the system of the public interest litigation against employment discrimination and expanding the qualification of the plaintiff and improving other systems.
