Worldwide, birth has gone through three stages, namely the natural birth stage, obligation stage and right stage. Birth right system in China despite turned up late, but it also experienced almost the same developing process. In modern society, various rights conflict with each other, all kinds of disputes continually turn up, in practice disputes of birth right are happened increasingly. With the development of the concept of human rights, more and more people make birth right also their self attainder. Birth right, in the law, has been widely recognized.With the 2010 "three amendments to the Marriage Law (Draft)"(hereinafter referred to as "the draft"), people focus on the problem of reproductive rights conflict between husband and wife again. what is the reproductive rights If wife abort without the husband's consent, her husband's reproductive rights are violated How shall the husbands ensure their reproductive rights realized Whether damages are involved A series of problems torture our legislature. In this regard, the author try to analyze the nature of reproductive rights, reproductive rights of empowerment, and infringement on reproductive rights etc, and make her understanding of "the draft".
