Discuss On Cyber Crime

In the background of economic globalization, with the rapidness of the informational process our country, especially Internet technology, the age of information networking greatly changes our habits and lifestyle. At the same time, the problem of network information security is outstanding. A cosmopolitism tough problem, cyber crime, is before us. The Panda case is a form of cyber crime. Cyber crime brings disharmony factors to the world. It occurs more and more frequently. Higher demands are requested to fight against crime, especially new form of cyber crime. With the further development of network, ways of cyber crime becomes more and more subtle to invest. It is difficult to invest, take the evidence, harder to prevent. Lags or loopholes are existed in relevant laws. Therefore, the study of cyber crime is being adapted to the development of the times and becoming more important.Except the preface and conclusion, the paper consists of three parts:Part I:the basic facts of "Panda" case. Starting with discussing the basic fact of the case, the paper the whole process, analyses whether the case is cyber crime or not, and exposes some social problems of the Panda Burns case.Part II:the legal analysis of the "Panda burns" case. To the characteristics of the "Panda burns", this section analysis the features of the'Panda'case, point out its harm to the society and analyses their criminal acts in this case. In this way, we can say that it is cyber crime.Part III:Way to solve the "Panda burns" case. In the last part, some ways to identify whether the panda burns is cyber crime or not. Some applicable laws and suggestions are listed and certain suggestions are given to solve the cyber crime.
