Ship-recycling industry has been called the "smoke-free metallurgy", tuning waste into wealth, recycling of resources, for the disposal of old retired ships providing a good way. The developing of Ship-recycling industry can timely dismantle the ship to prevent the over-age ships polluting the marine environment; on the other hand, it can supply a large amount of scrap steel to meet the need of the market, reducing expense on iron ore import.Meanwhile, the ship-recycling industry is a high pollution and high risk industry. If not pay enough attention on it, it is likely to cause environmental pollution and the damage to personal safety and health. In order to maximize safety and environmentally sound ship-recycling. "International Convention for the Safe and Environmentally Sound Recycling of ships" passed in May of 2009 in Hong Kong. The convention has become the first worldwide application of international mandatory provisions relating to ship-recycling.Currently, ship-breaking relevant legal provisions of china in various laws and regulations, the effect of different legal norms and the need to sort out; others, there's still many of related laws blank. So we need to make relevant legislative proposals.《Hong Kong Convention》also need to change to be the domestic laws.And the last two years, China has accelerated the scrapping of the relevant legislation. To this end, the legal issues related to the ship-breaking analysis is of practical significance and have practical value.Based on the relevant international law (mainly the《Hong Kong Convention》)analysis, and based on domestic law, to clarify the relevant provisions of domestic law and proposed legislation related to the recommendations of the space, making the ship-breaking related laws as much as possible of the system.This paper first introduced the article's significance, research contents and the status quo. Body part is divided into five sections, overview of ship recycling, and according to scrap the subject, object, direct actors to elaborate their own relevant laws and regulations, described the last ship-breaking pollution law. The first part of the ship-breaking industry, as well as finishing the specifications of our domestic shipbreaking line legal documents, the main provisions of the present and point out to analyze the defects and deficiencies; and analysis of relevant international conventions; the second part for the scrapping of the object—a dead ship, compared with domestic law and relevant provisions of the Hong Kong Convention and to make relevant recommendations; third part of the body in the ship-breaking-ship-recycling industry, compared the national law and the Hong Kong Convention the relevant provisions, and make relevant recommendations; fourth part of the direct action against the person in the Ship Recycling-ship-recycling workers, compared the national law and relevant provisions of the Hong Kong Convention and suggestions. Part V describes the liability of ship-breaking pollution, and administrative liability, civil liability, criminal liability to divide the responsibility of ship-breaking pollution laws.
