| Since it is introduced into China in the end of last century, Karaoke has received a wide recognition in the music market and has become one unique power in domestic music circle and television media. To sing Karaoke, which is favored by the public, is an important culture and entertainment consumption pattern at the present day. As a culture and entertainment industry category, Karaoke develops in a rapid pace and its huge market potential and economic benefits begin to emerge. Due to the lack of standardization in Karaoke industry, charging and protection of the copyrights is still under continuous exploration and improvement. And thus it is quite common to find prolonged legal disputes between Karaoke operators and record companies.In 2006, the Ministry of Culture and the State Copyright Bureau launched their own charging schemes, which make Karaoke copyright management and charging become a hot issue and receive a wide publicity from all walks of life. As Karaoke charging management concerned with complicated interest relationships and management hierarchy of different participants (copyright owners, Karaoke operators, third parties, government departments, consumers, etc.), the major problem to solve is how to design a reasonable and feasible system for the present issue.After examining theories and system construction concerning with Karaoke copyright charging management both at home and abroad, the author sums up existing problems and make a profound reflection about them according to the present situation in China. Learning from advanced practice and legislative experience of other nations, the thesis proposes an effective Karaoke copyright management system design to enrich and improve the existing charging system, hoping to make a contribution to relevant system construction and legal practice. |
