Research On The Protection Of Civil Interest In Tort Law

Civil interest as well as civil rights are both protected by Tort law in our country. But the tort law ignore the basic problem that which kind of civil interest or in what condition civil interest can be protected by tort law. In my opinion, both civil rights and civil interest are the proper interest law should protect. So it's a high time that we should set out these problems owing to the increase of disputes concerning civil interest. The text is divided into four parts altogether.The first part mainly concerns the meaning of civil interest,the feature of civil interest and the division of civil interest. The second part of this text comparatively introduces the way deal with disputes concerning civil interest of several countries in the continental law system and common law system. The third part analyzes the present situation about compensation system of civil interest loss in our country. The last part describes the prospects. The author drew a conclusion that the Germany mold may be suitable to our country. And we can set a series of regime such as case guidance to unify judiciary.
