The Legal Protection Of The Copyright Of Film And Television Programs Under The Internet Environment

The legal protection of the copyright of film and television programs under the internet environment are discussed a lot by domestic legal scholars. However, they usually specialize in one or several relevant subjects according to the legal provisions, hence a lack of systemicness. With more and more film and television programs being infringed, it is of particular importance that a systematic study of such protection be conducted. Adopting the methods of case analysis and baconian, this article includes the following three parts:The first part gives an overview of the copyright of film and television programs. It narrates from the following aspects:the concept of film and television programs, the feature of it compared with other types of works stipulated in the Law of Copyright, the difference between it and video programs, and the group of the creators, the complication of the content, the orientation of the value concerning the copyright.The second part includes the analysis of the current situation of infringement and its reasons. Combining with relevant cases published by the Second Intermediate People's Court of Beijing in four month, the author summed up the types and features of infringement through collecting and sorting out typical infringement cases in recent years. The author also carries out an analysis of the harm it could cause. Meanwhile, the author emphatically analyzes the reasons of infringement in terms of society and law respectively.The third part offers laws concerning the protection of such copyright under the internet environment. A brief introduction of legal protection system in International Treaty accordance with China's law and perfection measures. The discussion is conducted in three aspects:legislative protection, administrative protection and improvement of other ways of protection. In the following part, some suggestions are given to improve relevant legislation, enhance enforcement of law and introduce new ways of protection. In the final, the author gives his own opinion on the legal protection under the internet environment.
