The Right To Terminate The Performing Contract With No Reason

With the development of the spiritual needs of people, Entertainment industry has become a highlight of economic growth in many developed countries. "According to statistics, the annual income of the U.S. entertainment industry had reached 3,000 billion U.S. dollars , roughly accounting for 3% of GDP of the country. " Chinese entertainment industry is the representative of the new industry in our country. It has developed rapidly in recent years. However, incompatible with the increasing of the entertainment industry, Chinese law has not pay specific attention to the special problem of the entertainment industry, such as the performing contract.Performing contract is the main basis of long-term cooperation relations between artists and brokers. It provides foundation to solve the possible disputes between the parties. During the performance of the performing contract, the Artists or the brokerage may terminate the contract according to the right to terminate the contract with no reason. As to whether courts can support this claim, there are many disputes. So this paper will analysis this special contract and discuss the applicability of the right to terminate the contract in performing contract.This paper has three parts. The contexts are following:The first part introduces the basic theory of performing contract and the right to terminate the contract with no reason .This part is the foundation of the following research.In the second part, I analysis the necessity and feasibility to set the right to terminate the performing contract with no reason. Through my research, I consider that Chinese law need set the right to terminate the performing contract with no reason.In the third part , I discuss how to set the right to terminate the performing contract with no reason in Chinese law and how to regulate the excise of this right.
