Research On Administering Trademark Infringement Of Ziyuangang Leather Products

Trademark infringement refers to unauthorized use of mark which is the same with or similar to the registered trademark or other acts which damage the exclusive right of trademark without the permission of the owner of trademark. Trademark infringement problem, disturbing the order in developing the society and economy, infringing other people's lawful right and influencing the developing of social security and harmony, has been besetting the government management.It involves many theoretical and realistic problems in studying issues of controlling trademark infringement problems. And it is helpful to resolve the public's misunderstanding toward the government in dealing with trademark infringement problems, analyze the defects and blind spots of government's managing and practicing, improve the government management mode and guide as well as improve the government to make people-oriented and practical policies and administrative measures in building harmony society. Recently, the economic activities of ZiYuanGang leather products'business district keeps expanding with the problems of leather products'trademark infringement daily growing which has hindered the urban developing in economic order, investment environment, etc and even has exerted detrimental effects internationally.From the perspective of working practice and research, the writer do the study and discussion by taking the practical reality of the leather products sold in ZiYuanGang leather products'business district in Baiyun district, Guangzhou of which the trademarks are infringed. The reality of trademark infringement problems of ZiYuanGang leather products'business district mainly shows the characteristics of centralizing the famous trademarks and various infringement forms, etc. The existence of the problem results form the game playing between the proprietor and the supervision department. This paper, adopting methods in studying modern economics especially the game method, combining interviewing and data analysis and basing on the realistic data, studies the reality of trademark infringement problems of ZiYuanGang leather products'business district. The conception of risk cost is proposed by using economic principle of mathematic modeling method to analyze the basic reason which causes the problems of trademark infringement of ZiYuanGang leather products'business district. Furthermore, this paper discusses relevant controlling countermeasures, advises controlling comprehensively, strengthening enforcing and improving level of law enforcement, increasing the unlawful cost of trademark infringement and focusing on building scientific administrative evaluation system with an aim to efficiently control problems of trademark infringement and standardize the supervision of the market order.
