| The import contract for marine equipment, kind of contract for international sale of goods, has typical industrial character. The macro-environment and the marine industry business environment all have big effect on the contract, from the contract negotiation to the completion. The contractor may face many risks from the contract, such as the rights and the obligations,during the whole contract period.Legal consciousness of Chinese shipyards has just been built in late 20 years and great attention was paid to the newbuilding contracts.Quite few attentions have been paid in the past few years to the import contract for marine equipment.Compared with the suppliers, most of whom are leaders in the marine industry, Chinese shipyards are in a passive position regarding contract for international sale of goods. To avoid the risks and release the damages, domain shipyards should pay more attentions to the contracts.An agreed document should be negotiated and agreed between the shipyards and the equipment suppliers.According to the recent import conditions of marine equipment, this paper intends to discuss the import contract for marine equipment and give some advices on contract risks reduction.By PESTLE analysis,this paper first presents a brief introduction on the current condition of marine and shipbuilding industry. See from the Contract Law of People's Republic of China and United Nations Convention on Contracts for the International Sale of Goods, the article describe the normal terms of contract law and point out where the potential risks involved and how to avoid the risks. |
