In recent years, The development of the real estate market has become the main social and economic development, Developed real estate as a new model of a house sale, real estate market plays an important role in the modern. It is very different between the transactions of real estate and general transactions. In the transaction of real estate, it involve many mains and have a complex content and so on. So there are very different disputes in deal with the real estate laws. Mainly related to real estate law, contract law, consumer protection law, property law. In real estate transactions, the Dispute of the main reason is Real estate fraud. Therefore, how to prevent, regulate trade in real estate fraud is the key to solving the problem of real estate disputes. This article is divided into six chapters. The first chapter is Introduction, Describes the research background, purpose, significance, research methods and writing the basic ideas. The second Chapter is overview of real estate fraud transactions. Elaborate definition of fraud, How to identify fraud, fraud in the form, between the Fraud in the general merchandise and real estate transactions.The third Chapter is fraud in buying and selling real estate analysis and regulatory deficiencies in the system. Described real estate buying and selling of the common types of fraud and forms, Mainly from the Contract Law, Consumer Protection Law and property law point of view the defects of the trading system of real estate analysis. The forth Chapter is the common law and civil law legal system related to a critical analysis, it learned from the legislative summary of the contents.The fifth Chapter is describes the buying and selling of real estate fraud in the legal regulation. The one is the sale of real estate fraud in the proposed four measures to prevent, what's more, from the administration, contract law and property law were analyzed, how in real estate transactions to protect the buyer's legislative proposals. Again, in the sale real estate transactions of legislation put forward a system. Mainly from the establishment of a strict market access system, strict information disclosure system, sale housing the marking system and the punishment of the real estate market mechanisms and improve the four areas of real estate sale were put forward specific measures to improve the system. Finally, proposed the establishment of a unified real estate transactions law.
