Study On The Requirements To The Conditions Of The Patent Law Of The Computer Programme-related Invention

Patent protection for Computer Programme has been discussed for a long time,but the focus is different from among different stages of disscussion. As an emerging technological achievement,the choice of the means of the protection for Computer Programme by law have become a problem.Today,with the healthy development of the software industry, the advantages of the patent protection appeared, most countries have acknowledged the rationality of the mode of patent protection.This paper studies the following problems at first: the necessity of the patent protection for Computer programme. Then we will discuss the justification of patent protection on the Computer programme. We have to discuss the computer programme can meet the requirements to the conditions of the object of Patent law, and the satisfaction of the "three conditions" that required by the Patent law,then,we can prove that the patent protection of computer programme is possible.In short, this paper is based on the theory at this stages and study results from other developped countries, America,Europe and Japan. The Patent protection of Computer programme problems shoule be straightened out and analysed.
