Content:With the development of real estate, disputes aroused because of no information disclosure or incorrect information disclosure during the residential property conveyances. It is necessary to pay enough attention to Seller's Disclosure Obligation both in legal aspect and marketing aspect.The article examines Seller's Disclosure legislation, enforcement, and justice in residential conveyance throughout the Common Law legal system countries, such as the United State of America, Canada, and Australia, and the Civil Law legal system countries, such as France, Germany. Compared to the said western counties, China has its own legislation, enforcement, and justice system regarding Seller's Disclosure Obligation. The General Principles of the Civil Law of the People's Republic of China and the Contract Law set forth the general rules about Seller's Disclosure Obligation. Some provincial and municipal governments, for example, the city of Beijing and the city of Chengdu, make bylaws to govern the Seller's Disclosure Obligation.The article also analyzes the theory that the Seller's Disclosure Obligation based on. Some important topics, such as who is responsible for information disclosure, what to disclose, when to disclose, what consequences will be if the rules are not followed, are discussed in this article.
