The Special Safeguard System Against China: An Analysis

Foreign trade of China has increased rapidly and continuously during the past more than three years since China acceded to WTO, and created " China miracle "respected by all the world. However, China still faces " challenges "in many ways while enjoying its" opportunity ". China committed the Special Safeguard which is dead against China in the protocol on the accession of PRC; therefore, we have to undertake more obligations for the commitment at" product-specific ". In order to know the influence of the Special Safeguard correctly, and offer some feasible suggestions, this thesis made overall research on some important issues of the Special Safeguard from the law angle of view, These issues are: the source of the Special Safeguard, and it's characteristics; If WTO members provide due process and use objective criteria on the Special Safeguard; The present situation on WTO members implementing the Special Safeguard; some puzzles and their analysis on implementing the Special Safeguard; The Special Safeguard has any effect on China, any good measures to solve it.Methods this thesis used are clauses analysis, case analysis and history analysis. The research proceeded from five chapters. Chapter one, briefly introducing the source and development of safeguards, rules on existing WTO safeguards system; Chapter two, Analyzing in detail the source of the Special Safeguard, its basic system and characteristics; Chapter three, Recommending the legislation on the Special Safeguard against China that the principal trade partner provided and evaluates them; Chapter four, Investigating the situation of implementation on the Special Safeguard against China by WTO members, analyzes various kinds of factors about launching or enforcing the Special Safeguard against China . Chapter five, Analyzing several puzzles to the Special Safeguard and put forward my own views; Chapter six, Analyzing objectively how the Special Safeguard impacts on China, and put forward some countermeasures.The innovations: analyze the economic reason of the Special Safeguard's source, explaining the types of the Special Safeguard against China and their relations clearly, the statistic of implementation about the Special Safeguard and its reason, put forward my own views about the problems on implementing the Special Safeguard, and offer some countermeasures.
