| The government manageing foreign trade measures including the tariff measure and non-tariff measures . With the development of liberalization of trade, the function of the traditional tariff measure is dropping , Since the seventies of the 20th century, the impact on international trade of non-tariff measures become greater and greater. There are many kind of the non-tariff measures mainly: quantitative restrictions, technical trade barrier, safeguard measures, rule of origin , sanitary and phtosanitary measure, anti-dumping measures. And to the concern of human rights, the environment of correlating with trade, labor standards with the environmental question are evolved for the trend of the non-tariff measure in recent years. Seeing that the non-tariff measures are often used for protecting the domestic market, hindering the development of liberalization of trade, Both General Agreement on Tariffs and Trade and World Trade Organization Have made a series of regulations of the non-tariff measure, in order to control them. In addition, some regional economic integration organizations , such as European Union, North America free trade area while promoting liberalization of trade, Pushing the level of the governments manageing foreign trade up to new stage too, developed the non-tariff measures system.Chinese Government and ASEAN signed《Framework Agreement on Comprehensive Economic Co-Operation Between the Association of South-east Asian Nations and the People Republic of China》 in November of 2002 ,Both determine to build up China——ASEAN Free Trade Area in 2010 , realize the liberalization of trade in east Asia.. According to the stipulations of 24th of General Agreement on Tariffs and Trade, Free Trade Area must eliminate the duties and other restrictive regulations of commerce on substantially, Which means that governments of FTA depend on the non-tariff measures to manage foreign trade mainly. So making relative perfection, scientific non-tariff measures to China –ASEAN free trade area has very important meanings to work smoothly. Structuring the non-tariff measures of CAFTA , We should observe the World Trade Organizations relevant regulations, consulting other successful experiences of free trade area( Such as North American Free Trade Area). At the above understanding, this paper analyzes the non-tariff measures of North America Free Trade Area, And offers my advice how to structure the non-tariff measures of CAFTA.This text divides into four chapters altogether. Chapter one It is the outline, has introduced some common non-tariff measures at first, secondly analyzed the characteristic, the classification and impact on international trade, Lay the foundation in order to study non-tariff measures further. Chapter two focuses on the non-tariff measures of North America Free Trade Area, namely safeguard measures, rule of origin , sanitary and phto-sanitary measure. Safeguard Measure were divide into two categories:Substantial rule and procedure rule , And compare with WTO, pointing out its characteristic; analyzing sanitary and phto-sanitary measure by case law in order to explain relevant legal problems .The rule of origin is a core non-tariff measure of North America Free Trade Area, The Chapter examines the substantial transformation criterion, makes comparison, and points out the advantages and disadvantages. Chapter three Introduce the labor, environmental clauses of North America free trade area. The labor and environmental issues have already become the focus question of international trade, Sharp difference on the issues exists in developed countries and developing countries. North American free trade area made the new regulation to solve above-mentioned problems, Have analyzed 《North American Agreement on Labor Co-Operation》and《North American Agreement on Environmental Co-Operation》 in this chapter,Chapter four gives a brief introduction of the current non-tariff measures systems of China and AFTA at first, And has pointed out its shortcomings, finally suggest some opinions.
