On The Realization Of The Impartial Judicature In China

With the development of the socialist market economy and the aim of founding a socialist state ruled by law being raised, judicature is becoming the more and more important means of solving the contend. The realization of the impartial judicature is the important content to found a socialist state ruled by law, which will forward the development of the respective cause of socialism. As for the present situation in china, the impartial judicature hasn't really and comprehensivly been realized. So the impartial judicature is becoming the subject that the Chinese theory area must answer. To realize the impartial judicature, we must make clear what the impartial judicature is. In a long time, the meaning of the impartial judicature is in an indistinct state, which affects people's considering and understanding about the impartial judicature. At the base of accuratly analyzing the meaning of the impartial judicature, this thesis endeavours to excavate the value of the impartial judicature for politics, economy and culture, and delivers that the impartial judicature is a subject of not only executing the law but also legislation. At the same time, the author analyzes the components in the two areas of affecting the impartial judicature in china. After the analysis of these factors, the author thinks we should work hard at the legislation, the independent judicature and the judge institution etc. The realization of the impartial judicature is an important subject of not only theory but also practice. During the course of seeking the path of realizing the impartial judicature in china, the author fully refers to the successful experience in the westen states, and raises some thoughts and suggestions of mine at the base of integrating the true situation in China.
