Discussion On The System Of House-owner Committee

With the deepening of innovation of housing system ,real estate management system appeared. In recent years, the dispute resulted from the real estate is surging .among which,the most important and most can't be neglected problem is the relationship between the house-owner committee and real estate management company. Their conflict is often caused by the interest in the process of service supplying.As one party of conflict, the function of the house-owner committee is very important like bridge and tache.so in order to resolve all the problems,the most important thing is to ensure the status of the house-owner committee and study further to this system,But in our country,the statute of real estate management is implemented not long,its still a new thing to us,the legislation about which is still less and the system is still far from perfection.In this paper,the author study from the status of the house-owner committee is the real estate management system, and analyzed the many present problems existing in the house-owner system.Firstly, the absence of the legislation about house-owner committee recognization,the legal status of which is still unclear.secondly, its still difficult to set up the house-owner committee in practice,the unclear regulation about member qualification limitation ,the complex setting- up procedure and the hindrance of the administrative department ,all of these make it difficult to set up the house-owner committee. Thirdly, the house-owner committee can't function well, a large number of house-owner not realized the feature of committed clearly, the member of committee is less educated. The fourth,the procedure rules of house-owner committee is difficult to put into practice. The fifth, the real estate service contract has many problems,as the management right is not clear,the collecting ,keeping and using is not explicit. The sixth, the scarcity of the regulation about supervision to house-owner committee, such as supervision body and supervision duty. Aming to supplying some suggestion for reference to construct our house owner committee system, the author put forward some legal advice here.
