The Analysis Of The Interrelation Between The Brain Drain And The Protection Of Owned Technology In Technology Enterprise In The Viewpoints Of Economics Of Property Rights

In the recent years, as a result of brain drain, the situation of leakage of business technological secrets is becoming more and more serious, which is a threat to the interests even existence of the enterprises. The technology enterprises, especially, become the bad victims of leakage of technological secrets. This paper accedes that rational brain drain is essential request for market economy, and it stimulates the advancement of the technological level of the enterprises and the society. However, due to the imperfect system of property rights and the nonstandard market order, this paper thinks too that brain drain inevitably does great harm to both enterprises and society. It is how to deal with the interrelation between brain drain and the property rights protection of owned technology in technology enterprises that is the subject with great theoretic value and great practical meaning in economic and technological development in our country.On the basis of analyzing the feature of property rights of human capital and of technology in the enterprises, this paper holds the view that the property rights of owned technology of the enterprises are not clear to a certain extent. So the interests of the investors are difficult to balance. Meanwhile, owing to the conflict appearing with the development of technology enterprises, if the interests of the technologists are not ensured, they may leave office, which may bring a great loss to the enterprises. In the end, in allusion to the feature of property rights of human capital of the technologists and of owned technology in the technology enterprises, the paper puts forward corresponding suggestion from the aspects of clearing up property rights, encouraging as well as system-constituted of both the interior and the exterior of the enterprises and so on in order to ensure the interests of both sides. Through the analysis of the paper, we can catch on the reason of brain drain from a new perspective, and it can provide a reference for rational brain drain .
