The contradiction between the scarce and non-reproducible land resources and the infinite and exclusive demands requests that we should make the depositing capacity of land live to make the land use more reasonable efficient. Land Transference is one of the way by which the land resources are distributed on the base of the market mechanism.The measures to realize urbanization and industrialization are active to improve the social and economic standard, especially to solute the problems existing in the agriculture, the peasants and the rural. At the same time, urbanization and industrialization means the transferring of the rural land use namely, the construction transference of the rural land. Nowadays, the Construction Transference of the Rural Land has two ways: one is the transference between (even peasant) and the land users, which includes the transference of the agricultural land and the rural construction land; the other way is to expropriate rural land to make it(which belongs to collectivity ) belong to the nation . The aftermath of the former in one hand is that great land assets and farming land decrease fast, and that the operation in gear of the land market is influenced. On the other hand , low efficiency of the construction land and discontentment with the compensation induce peasants to appeal to the higher authorities for help, which causes the social emotional instability and the behaving ofthe private (illegal) transference of the agricultural land and the rural construction land. The original reason of these problems lies in our faulty property right system in rural land.Aiming at the above-mentioned problems, this paper analyzes the deeply reasons in property right system. The management right of the national takes the place of the ownership of the peasants; right structure is not perfect and the ownership is absent and wrong, and the setup of the right structure could not meet the demands of the reality. And on the base of the analyses, this paper makes the property right of the rural land clear, points that we should give the master of the land his deserved right and make the ownership perfect, and then sets up the development right of the rural land which means to improve the impressing compensation of the peasants to make it corresponding the value of the ownership of the land in the true life.The ultimate purpose of making sure the land property right is to realize the profits of the interest owner. Therefore, on the base of analyzing the problems of the construction transference of rural land and consummating the rural land property right system, this paper constructs the standard of the expropriation compensation which will be influenced by the elements such as the acreage of the impressed, the proportion of impressed to total number of the peasants, the per capita land possessing in the rural land impressed area, the income of the citizen and the saving standard, the position of the impressed land, and the per capita GDP, the per capita pure income and the structure of the peasants in the impressed area. In addition, in terms of the principle of "who profit who burned", the resources of the compensation capital are put forward in the paper. The paper also suggests constituting the society guaranteeing system, including insurance system to the aged, hospital insurance system and the minimum life guaranteeing system. In the end, the correlation measures are brought forward to make the peasant interest come true in the construction transference of rural land.
