The Legal Protection Of The Employment Security Right

The employment security right is regarded as one of the most importance on the life right and the healthy right of labor which already has received the extensive concern of every country. However, our country, China has only stipulated the protection of the right of employment security in" labor law" and scattered rules and regulations. A large variety of phenomena to infringe the employment security right in the field of labor relation has not been made the due legal sanction without concern of legal system. This paper is directed against our country's disappearance in protecting the right legislation of employment security. After expounding the urgency, necessity, rationality and legitimacy of protecting the right of employment security in our country, it proposes that we should increase a series of regulations about protecting the employment security right. When the employment security right is to take protection so that laborer and judicial authority can abide by laws, protecting a laborer, steadying the labor relation, thus creating the good environment for the development of market economy.The paper to set about employment security right from the value of the question perspective, has described the current situation, drawback and evaluation and analysis of the right mechanism of legal protection of employment security of our country separately. At last, the author put forward some idea to the reform and development of the right legal system of employment security of our country on the basis of analyzing the current situation and reference meaning of the right legal protection system the international employment security. The paper is divided into four major parts. The first part investigates the perspectives value of the right of employment security. The author tries to answer the relations of employment security right and human rights, employment security right and the right of labor in this part. It has a three-dimensional description of requisition of the development of human rights and the right of labor to employment security and the facilitation of employment security right to human rights and right of labor. And then the author gives a definition that the employment security right means laborers on-the-job family win guarantee personal safety and healthily, thus exempt from the right of the job injury. The author states the necessity and importance of the existence of employment security right from the just angle of the society and the angle of economic development at the same time.The second part studies two problems. On the one hand, through the analysis of the current situation of legal protection of employment security right of our country, it exposes that the speed that we study and take advantages of the successes and failures to strengthen our industrialization is so slow that it falls short of the requirement, under the current enormous pressures of domestic economic development and international competition though our nation has paid certain attention to the protection of the rights of laborer`s employment security. On the other hand, the current situation of the employment security right, to announce out that the current laws and regulations to protect the aspects of the relevant employment security have the defects of being scattered, short of the supervision effectively. Therefore, the author suggests that it is urgent to set up certain laws and regulations to protect the right of employment security perfectly.In the third part, the author has described the current situation about the legal protection system and referential meaning of the international right of employment security. A lot of countries and regions in the world have made the laws on the employment security.
