Human being has an unvarying dream , which each family owns their houses. Some delightful changes have taken place in the housing market in our country since government brought forward the policy of privately owned domiciles and calling off the allocation.Nowadays built and building preferential houses in the town and commodity housing ,due to a large of amounts, orderly correlate with the growth. Emphasis are not put upon the study of above property right of real estate, and there are some unreasonable arrangement in dealing with property right. This article, making reference to other countries' correlative policies , analyze property right of real estate in the town.The article is divided into three parts. The first part discusses factual property right of real estate in the town . The second explains the property right theory and housing' rights. The last puts out some policies and suggestion how to arrange , protect and dispose of property rights.The main viewpoints of this thesis are as following:1.Nowadays preferential houses' rights is blur because of opaque share between the country and the individuals, and owners can't completely understand the rights of common hi the mansion. So to speak, the definition of property rights can't adapt to the development of housing market.2. Property right has diversity and can be dismembered through the explanation of concept and review of theory. As a kind of exclusive right, it is a reasonable, anticipative and social tool which can reduce transaction cost by the abatement of complexity and uncertainty in the exchange of commodity.3.On the arrangement of property right of mansion, the article use for reference to foreign systems, analyze the rights of the ground, rooftop, lift and underground park and discuss the possessions, use and distribution of income oncommon parts.4. A series of policies and measures on the perspicuity, protection and transfer of rights are put forward in the article. The government should define all housing as private possessions , stipulate the personal right share in the contract, establish perfect city housing information system, adopt consultation and insurance of property right to provide guarantee, and rectify the behavior of management and investor.
