Research On The ICSID Jurisdiction

The trend of economy globalization won't take a turn .The link among nations is getting tighter and tighter. There is no nation that can develop well with its door closed. It's well known to all us .The economic development in every nation can't leave investment. The international investments have been the huge force to promote the economic development. There produced a great amount of investment disputes with the vigorous development of the international investments. The effective resolution of the investment disputes will spur the development of the investment. So the importance of ICSID is prominent now.After China takes part in WTO ,we see more clearly that only to understand^ to abide by and handle with ease the regulations of the international games can we keep the friendly partnership with other members in the same "earth village". As a member of "Convention on the Settlement of Investment Disputes between States and Nationals of Other States",' China brooks no delay to master the ICSID rules and put it to use, since the income and output of the investment in China is enlarging everyday. Thus the investment disputes are becoming more and more. Operating the ICSID machinery to resolve disputes is welcomed by the investors and other convention members. The scholars, such as Mr.Broches and Mr.Christoph have had a deep research about the ICSID matters, however Chinese scholars' research about it is quite shortcoming. We may be happy that Professor Chen An as the deputy of the scholars in Xiamen University has contributed a breakthrough research.This article tries to make some helpful inquiry into the heart matter of ICSID, that is, the jurisdiction of the center. Chapter Imakes a comparison between several methods of investment disputes resolution. Chapter II analyzes the premise for the center jurisdiction. Chapter III explains the exclusiveness of ICSID. Finally Chapter IV talks about the jurisdiction affirmation.
